VISA TERMS AND CONDITIONS

APPLICABILITY OF THE TERMS AND CONDITIONS:

Any person (“The Customer”) who intends to avail or avails VISA services of the Company shall be subject to the terms and conditions as detailed below.

By instructing the Company to undertake services on your behalf, the Customer is deemed to have accepted these terms and conditions. These Terms are to be read in conjunction with MMT’s User Agreement and Privacy Policy.

SCOPE OF SERVICES AND PROCEDURE:

At the outset, the Customer agrees that they understand that the approval/rejection of visa, is at the sole discretion of the concerned Embassy/High Commission. MMT has no role in either assessing or processing the visa application. The scope of services offered by MMT w.r.t visa services is detailed hereinbelow.

  • MMT will provide the Customer with the information necessary for the visa application process (as provided by the respective Embassy/High Commission) along with the average time taken for the processing of a visa application, to enable a customer to apply for the visa in a timely manner. Such information shall be provided on ‘Best Effort’, on the basis of MMT’s experience in providing such services. Information and visa requirements are subject to change and MMT does not warrant that information provided by it will always be accurate or complete.
  • All requirements for making a visa application (including, but not limited to, documentation, fees and time frames) are calculated based on general criteria and can vary due to a lot of factors including but not limited to the information provided by Customer (including, but not limited to, current or previous nationality, residence, gender, age, profession, recent travel and religion). MMT shall not be liable for any additional/different requirements that may be raised by the concerned Embassy/High Commission.
  • Each country has varying requirements for passports and VISAs. For eg. Certain nations require a minimum number of blank pages in succession or period of validity. These requirements are established by sovereign nations and are subject to change without notice. While MMT always try and ensure, its Customers are given, correct and updated information, there may be instances where the requisite is not made available to MMT, as a result of which MMT may not be able to provide the same to its customers. In such cases, MMT will not be held responsible for any inaccuracy in such information.
  • Each country has varying requirements for passports and VISAs. For e.g., Certain nations require a minimum number of blank pages in succession or period of validity in the passport. These requirements are established by sovereign nations and are subject to change without notice. While MMT tries to ensure that the information it provides is complete and correct, however, MMT cannot provide any guarantee or warranty in this regard. MMT will not be responsible for any inaccuracy in such information.
  • The services offered by MMT should not be considered or construed as visa advisory services in any manner whatsoever. MMT shall only provide a check list of documents to its customers as is prescribed by the concerned nation/country for the purposes of applying for visa and/or as per the best available information of MMT. For submission of documents, MMT may only cross-check the presence of documents as per the check list without reviewing the contents of each document. MMT will also not advise on the merit of the documents and the likelihood of approval or rejection of the visa being applied for.
  • MMT may provide the services mentioned here itself or through third parties. MMT may also appoint third party vendors for the visa application process for different countries. Such third party vendors will be responsible for applying for the visa of customers for the respective countries they have been appointed for

The customer undertakes to provide the documents required (as mentioned in the checklist) for the processing of the visa, promptly to MMT. The customer further undertakes that the documents submitted are genuine and further the information provided by the customer is true and correct. MMT shall bear no responsibility to verify the genuineness of the documents or the information provided. MMT in no manner checks the credentials of the documents given by the customer and only cross checks the same with the checklist provided to the customer. Customers are also required to provide to MMT all necessary and correct information, to allow MMT to submit application for visa processing, such information may include, but is not limited to, the Customers name, address, holiday destination, and any other information which MMT considers necessary for the purpose of processing the Customer’s visa application. Once Necessary Information is supplied by a Customer to MMT, he/she agrees for MMT to file necessary VISA application along with Visa Fees/Embassy charges on its behalf to concerned consulate/embassy. Customer also understands that once visa application is filed by MMT on their behalf, the concerned consulate/embassy/high commission, may call the Customer for a face to face interview at its sole discretion. MMT shall have no role to play in this process and shall, where applicable, inform the Customer about the date, time and requirements (if any) as communicated by the concerned Embassy/High Commission.

For UAE Visa: OK TO BOARD may be required. Customer understands that it is the complete discretion of the concerned Airline/ department to grant or reject ’ok to board”. Customers are required to provide valid communication details (mobile number/ email id) at the time of applying for the Visa / OK TO BOARD services, as these will be the only point of contact for timely update on the status of Customer Visa / OK TO BOARD application by MMT. Customers are requested to provide air tickets within 12 hours of the receipt of e-mail regarding OK TO BOARD requirement.

SERVICE FEE

The Customer agrees to pay MMT a Service Fee towards the cost of providing the services of submitting the application on the Customer’s behalf to concerned Embassy. The Service Fee will be paid in addition to the Visa fees, Embassy charges and other similar fees by applicable nomenclature or as prescribed by the respective visa department of a State. Customer is liable to pay the Service Fee at the time confirmation is given by him/her to avail services of MMT.

Any additional charges, including for logistics, i.e. pick up of documents, collection of passport etc. or any courier charges shall be in addition to the service fees mentioned above.

Visa Fees, Embassy charges/taxes/and other miscellaneous charges as applicable, are not under the control and discretion of MMT and are subject to changes at any time as and when prescribed by Embassies/Government Authorities without issuing any prior notice to MMT. MMT hereby disclaims any liability with respect to any changes imposed to the Visa Fees by any Embassy and/or Government Authority at any point of time. In case of any change in the rate of Visa Fees prescribed by any Embassy and/or Government Authority, the customers thereby will be liable to pay the revised rate of Visa Fees applicable on the date of submission of the Visa application at the Embassy and/or Government Authority, in order to proceed with the processing of the Visa application.

In a circumstance wherein the customer has paid the Visa Fees in advance to MMT, and post such payment if the Visa Fee charges are revised by the Embassy and/or Government Authority, then MMT will be entitled to recover the differential amount from the customer as per the new rate of Visa Fees applicable on the date of submission of the Visa application at the Embassy and/or Government Authority.

CANCELLATION FEES/CHARGES:

Customer agrees that once a Booking ID for a visa application is generated, the Service Fee of MMT shall be non-refundable. However, the visa fee maybe refundable only till such time the application is filed. Once the application has been submitted to the concerned Embassy/High Commission, visa fee will be non-refundable. The aforesaid is as per the guidelines of the Embassy/High Commission and MMT has no control or authority over it.

LIMITATION OF LIABILITY:

MMT solely acts as a facilitator for Visa processing and is not responsible for grant or rejection of visa in any manner whatsoever. Issuance of VISA is a sole decision of concerned Embassy/ High Commission and MMT is not liable for the same. MMT shall not be liable for any incidental cost/expenses incurred by the Customer pursuant to any denial or delay of visa application for any reason whatsoever.

  • Once MMT returns passport and documents, it is the responsibility of the customer to check that all requisite VISAs have been obtained and details mentioned therein are correct and matches the travel itinerary. In case of any error on the visa, kindly write to us at Visamailers@makemytrip.com within 12 hours of the receipt of the visa approval. Our customer service representative will contact you. MMT shall not be held responsible for (including but not limited) to financial loss if the issue isn’t highlighted within 12 hours of the receipt of the visa approval.
  • Customer shall also check his/her personal details mentioned on the VISA issued. Customer shall also understand that even when a VISA is issued, he/she may be denied entry as it is the local immigration authorities which have a final say on entry decision and in that case MMT cannot be held liable.
  • MMT also recommends that Customer shall secure VISA prior to date of departure. MMT will not be liable in any respect or for any loss or delay caused by events including but not limited to acts of God, weather conditions, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities (including passport and embassy consular officials). Customer also agrees that in case of rejection, if Customer wishes to reapply/appeal against rejection of the Visa, MMT shall do the same strictly pursuant to the instructions of the Customer. The reapplying/appeal shall be a fresh transaction and the Customer will be liable to pay the applicable fee for such reapplying/appeal process along with service fee to MMT. Unless instructed by the Customer, MMT will not initiate reapplication of any Visa application.

For visa applications where submission of passports is required, MMT shall take all necessary steps to ensure that the passport is safely delivered to the customer. However, the Customer agrees and undertakes that MMT shall in no way be held liable if the passport is lost in transit or misplaced.

COUNTRIES FOR WHICH THE SERVICES ARE BEING OFFERED

The countries for which the visa application services are being offered is mentioned in the visa section of the desktop site and the mobile app. The list of countries is subject to change at the discretion of MMT.

MODIFICATION OF TERMS AND CONDITIONS:

MMT reserves the right to change the terms, conditions, and notices under which the MMT websites are offered, including but not limited to the charges. The Customer is responsible for regularly reviewing these T&Cs.

JURISDICTION:

MMT hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. MMT considers itself and intends to be subject to the jurisdiction only of the courts of Delhi, India.
